Welcome to Capital Appraisals ("we," "our," "us"). By engaging our real property appraisal services, you ("client," "you") agree to the following Terms of Service. Please read them carefully before proceeding with our services.

1. Scope of Services

Capital Appraisals provides independent real property appraisal services in Yukon Territory and Northwest Territories. Our services include but are not limited to:

  • Property valuations for mortgage financing, estate settlements, litigation, insurance, tax purposes, and real estate transactions.

  • Market analysis and consulting.

  • Inspections and research to support valuation reports.

All appraisals are conducted in accordance with the Canadian Uniform Standards of Professional Appraisal Practice (CUSPAP) as set forth by the Appraisal Institute of Canada (AIC).

2. Client Responsibilities

By engaging our services, you agree to:

  • Provide accurate and complete information necessary for the appraisal process.

  • Allow reasonable access to the property for inspection, if required.

  • Understand that appraisal values are based on current market conditions, professional analysis, and available data.

  • Acknowledge that an appraisal is an independent opinion of value and does not constitute a guarantee of property sale price.

  • Disclose any known deficiencies, defects, or other factors that may affect the marketability or value of the property, including but not limited to structural issues, legal disputes, environmental concerns, zoning restrictions, or financial encumbrances.

Failure to provide accurate information or access may impact the accuracy and completeness of the appraisal. Failure to disclose material deficiencies or factors affecting marketability may render the appraisal invalid. Capital Appraisals disclaims responsibility for omissions caused by the client’s failure to provide complete and accurate information.

3. Fees and Payment Terms

  • Our fees are based on the scope and complexity of the appraisal and will be disclosed before services begin.

  • Payment is due upon completion of the appraisal report, unless otherwise agreed in writing.

  • Unpaid invoices beyond 30 days may be subject to interest charges of 2% per month (24% annually).

  • Additional charges may apply for out-of-scope services requested by the client.

We reserve the right to withhold final appraisal reports until full payment is received.

4. Confidentiality and Privacy

Capital Appraisals adheres to strict confidentiality standards under CUSPAP and the Personal Information Protection and Electronic Documents Act (PIPEDA).

  • Client information and appraisal reports will not be shared with third parties without written consent, except as required by law or professional obligations.

  • Personal data is stored securely and retained only for as long as necessary for business and legal purposes.

5. Limitations of Liability

  • Capital Appraisals provides independent professional opinions but does not guarantee property values, market conditions, or future sale prices.

  • We are not responsible for errors or omissions in public records, third-party data sources, or information provided by clients.

  • In no event shall Capital Appraisals be liable for indirect, consequential, or special damages arising from the use of our appraisal services.

  • Our maximum liability in any claim shall not exceed the total fees paid for the appraisal service in question.

6. Report Usage and Third-Party Reliance

  • Appraisal reports are prepared for the intended user(s) and purpose stated in the report.

  • Clients may not distribute, reproduce, or modify reports without prior written consent.

  • Third parties, including lenders, legal representatives, and government agencies, may not rely on an appraisal report unless specifically authorized in writing.

Unauthorized use of an appraisal report invalidates its reliability and Capital Appraisals disclaims any responsibility for such use.

7. Cancellations and Refunds

  • Clients may cancel an appraisal request before the inspection or research phase without penalty.

  • If an appraisal is canceled after work has begun, a partial fee may be charged based on work completed.

  • No refunds are issued once an appraisal report has been completed and delivered.

8. Compliance with Laws and Standards

  • Capital Appraisals operates in compliance with all applicable laws, regulations, and CUSPAP standards.

  • Clients agree to use appraisal reports lawfully and ethically.

Any attempt to influence, misrepresent, or manipulate an appraisal outcome is strictly prohibited and may be reported to the Appraisal Institute of Canada (AIC).

9. Dispute Resolution

  • Any disputes regarding appraisal services should first be addressed in writing to Capital Appraisals.

  • If the matter cannot be resolved, both parties agree to mediation before pursuing legal action.

  • Legal disputes shall be governed by the laws of Yukon Territory, and any litigation shall be conducted in Whitehorse, YT.

10. Updates to Terms of Service

Capital Appraisals may update these Terms of Service periodically. The latest version will always be available on our website or upon request.
